Terms and conditions
These Terms and Conditions (“Terms”) govern the contractual relationship between you, as a Participant, and Yema (“Yema”, “we”), in the context of your application, booking and participation in a retreat. Please read them carefully before booking. By paying your deposit, you confirm that you have read, understood and accepted these Terms in full.
For any question before booking, please write to us at yema.retreats@outlook.com.
1. Definitions
- “Yema” refers to the legal entity operating the Yema brand (see Legal notice above), together with its founders, facilitators, team and authorised representatives.
- “Retreat” refers to any programme offered by Yema — as described on the website at the time of booking — typically including preparation, immersion, psilocybin ceremony or ceremonies, and integration.
- “Participant” refers to any person submitting an application to attend a Retreat, whether or not their application is subsequently confirmed.
- “Deposit” refers to the sum paid at the time of booking confirmation, which forms part of the total Retreat fee and is non-refundable except in the circumstances expressly set out in these Terms.
- “Health screening” refers to the confidential medical and psychological questionnaire completed by each applicant as part of the admission process.
2. Application and screening
Every application begins with a free discovery call. If there is mutual interest, you will be invited to complete a confidential questionnaire covering your physical health, any psychiatric history, current medications and any other relevant background.
You agree to provide truthful, complete and up-to-date information. Accurate disclosure is a condition of your participation, not only of your booking. False, incomplete or misleading information discovered before, during or after the Retreat may result in the withdrawal of your place without refund, or in any other measure reasonably necessary to protect your safety and that of the group.
Yema will not be liable for any harm arising directly or indirectly from information you failed to disclose or misrepresented during the admission process.
Participants must be 18 years of age or older at the time of the Retreat.
3. Nature of service and informed consent
Yema offers structured accompaniment combining preparation, individual and group support, psilocybin ceremony and integration. Our work is designed to support inner exploration, insight and overall wellbeing.
Our services are personal development and psychospiritual in nature. They do not constitute clinical psychotherapy, medical treatment or psychiatric care, and are not offered as such. Participation in an Yema retreat does not create a therapeutic or clinical relationship within the meaning of any professional regulatory body.
By submitting an application, you acknowledge and confirm the following:
- You are choosing to engage with psilocybin freely, voluntarily and without coercion of any kind.
- You understand that psilocybin is a psychoactive substance producing significant alterations in perception, cognition, emotion and sense of self. These effects are variable, cannot be fully predicted in advance, and differ from person to person and from session to session.
- You understand that the experience may involve intense psychological or emotional content (anxiety, grief, fear, confusion, encounter with difficult personal material). Such experiences, while challenging, fall within the known range of responses to psilocybin and do not in themselves constitute harm or emergency.
- You understand that physical effects may occur during the active period (nausea, elevated heart rate, changes in body temperature, impaired coordination and balance).
- You understand that the psychological effects of psilocybin may extend beyond the Retreat itself, including during the integration period. Yema provides structured support before and after the ceremony, but cannot predict or guarantee individual outcomes.
- You confirm that you have disclosed all relevant medical, psychiatric and medication information in your screening questionnaire.
- You confirm that you are not participating under duress or at the direction of any third party.
No guarantee of outcome. Yema does not guarantee any particular result, experience or therapeutic benefit. Outcomes are inherently subjective and depend on individual factors that are not within our control. Any statements made in our materials about potential benefits reflect the experiences of others or current research — they are not promises or predictions about your individual experience.
4. Contraindications
Psilocybin is not suitable for everyone. Certain medical or psychiatric conditions, and certain medications, significantly increase the risk of a difficult or harmful experience. Our screening process is designed to identify them carefully.
You are responsible for disclosing any relevant information. If you are in any doubt about your eligibility, we invite you to discuss it with your GP or a qualified healthcare professional before applying. A detailed list of contraindications is available on the Our approach page.
5. Psilocybin truffles
Retreats held in the Netherlands include one or more ceremonies using truffles containing psilocybin. For legal reasons, the truffles are not included in the Retreat fee and remain your direct responsibility (approximately €30), to be paid separately before the start of the Retreat. We will explain in advance how to obtain them in accordance with Dutch law.
6. Participant conduct and the group container
Yema retreats take place in a shared, intentional space. The quality and safety of that space depends on everyone present — participants and facilitators alike. By confirming your booking, you agree to uphold the standards of conduct described below throughout your participation, including during preparation and integration phases.
You agree to:
- Treat fellow participants, facilitators and all Yema team members with respect.
- Follow the guidance of facilitators during ceremonies and at any other point where your safety or the safety of others is at stake.
- Remain within the designated retreat space during ceremonies.
- Disclose, as early as possible, any changes to your physical or mental health that arise before or during the Retreat.
- Engage honestly with the preparation and integration process to the best of your ability.
You agree not to:
- Bring or consume any substances — alcohol, cannabis or other psychoactive substances — onto the Retreat premises without the explicit prior written agreement of Yema.
- Engage in any conduct that is physically threatening, sexually inappropriate or psychologically harmful toward any other person present.
- Photograph, record or otherwise document any part of the Retreat — including other participants, facilitators or the ceremony space — without the explicit consent of all individuals concerned and the written permission of Yema.
Confidentiality within the group. What is shared by others within the Retreat is shared in confidence. You agree not to disclose, reproduce or share the personal disclosures of other participants outside the Retreat context, during or after the programme. This obligation continues after the Retreat ends. It does not prevent you from speaking about your own experience.
Removal from a Retreat. Yema reserves the right to ask any participant to leave a Retreat, before or during the programme, if, in the sole judgement of the team, their presence poses a risk to their own safety, the safety of others or the integrity of the group container. No refund will be issued in such cases. Costs arising from an early departure (travel, accommodation, etc.) remain the sole responsibility of the participant.
7. Pricing, deposit and payment
The fee for each Retreat is set out on the website at the time of booking and confirmed in writing in your booking confirmation. All fees are stated in Euros, exclusive of any applicable taxes.
Deposit. Every booking is confirmed by payment of a deposit, which forms part of the total fee and is non-refundable except in the circumstances set out in articles 8 and 9. The amount of the deposit is stated in your confirmation.
Balance. The balance is due no later than four (4) weeks before the start of the Retreat. A payment plan may be arranged on request — all instalments must be paid before the start of the Retreat. If a payment is more than fourteen (14) days overdue, Yema reserves the right to cancel the reservation; amounts already paid will not be refunded.
Reduced-rate places. Two places per Retreat are offered at a reduced rate, intended for people on low incomes or from socially underrepresented communities. Please see the Retreats page or contact us for details.
8. Cancellation by you
If you need to cancel your booking, the following terms apply depending on how far in advance you notify us in writing at yema.retreats@outlook.com:
- More than 12 weeks before the Retreat start date — full refund of all amounts paid, except for the non-refundable deposit. You may also choose to transfer the full value of your payment toward a future Retreat (within 12 months) at no additional charge.
- Between 8 and 12 weeks before the Retreat start date — refund of 50% of the fee (excluding the deposit). A full transfer to a future Retreat (within 12 months) may be considered on a case-by-case basis.
- Between 4 and 8 weeks before the Retreat start date — refund of 25% of the fee (excluding the deposit).
- Less than 4 weeks before the Retreat start date — no refund is possible. At this stage it is rarely possible to fill a vacated place, and the costs associated with your participation have already been incurred.
In all cases, please contact us as early as possible if your circumstances change. We will always seek a fair solution where one is genuinely possible.
Early departure. If you leave a Retreat before its scheduled end — whether voluntarily or at Yema's request — no refund will be issued.
Travel insurance. We strongly recommend that every participant arranges cancellation insurance, as well as travel and medical insurance for the country in which the Retreat takes place. Our cancellation policy applies regardless of whether you hold insurance, and we are not responsible for uninsured losses.
9. Cancellation by Yema and force majeure
Yema is committed to delivering every Retreat it confirms. Cancellation by Yema is exceptional. In the rare event that we cancel a Retreat for reasons other than force majeure, you will be offered:
- A full transfer of your payment to a future Retreat within 12 months;
- A credit note for the full amount paid, valid for 12 months;
- Or, if neither of the above options is workable for you, a cash refund of all amounts paid, including the deposit.
Force majeure. Neither party will be considered in breach of these Terms if the Retreat cannot be delivered due to events genuinely beyond reasonable control. Force majeure events include, without limitation: war, armed conflict, terrorism or civil unrest; government orders, border closures or travel bans; changes in applicable law rendering delivery of the Retreat unlawful or impossible; natural disasters, extreme weather or environmental emergencies; epidemics, pandemics or major public health emergencies; strikes or major disruptions to essential services.
Force majeure does not automatically entitle participants to a refund. Where a force majeure event prevents Yema from delivering a Retreat, we will offer a transfer to a future Retreat or a credit note of equivalent value as a first response. Whether a cash refund is available will be assessed on a case-by-case basis depending on the nature and financial impact of the event.
10. Photography and image rights
To protect the confidentiality and dignity of everyone present, photography and recording are in principle not permitted in shared Retreat spaces (ceremony room, group session spaces, communal areas), except where Yema has explicitly organised and communicated a photography moment.
Yema reserves the right to photograph or record certain moments for internal documentation. No image of you will be used for external communication (website, social media, promotional materials) without your prior written consent.
11. Limitation of liability
Yema takes the safety and wellbeing of participants seriously and maintains rigorous screening, preparation and facilitation protocols. However, participation in a Retreat involves engagement with a psychoactive substance and an intensive psychological process. As set out in article 3, certain risks are inherent to this work and cannot be entirely eliminated.
By confirming your booking, you acknowledge that you have read and understood article 3 (informed consent), that you have disclosed all relevant information accurately, and that you are participating on the basis of a free and informed decision.
What Yema is responsible for. Yema is responsible for providing its services with reasonable care and skill. This includes conducting thorough participant screening, providing experienced and supervised facilitation, maintaining a safe physical environment during the Retreat, and responding appropriately to medical or psychological emergencies as they arise.
Nothing in these Terms affects any rights you have under applicable law that cannot be excluded or limited by contract, including in relation to death or personal injury caused by negligence, or fraud.
What Yema is not responsible for. Subject to the above, and to the fullest extent permitted by applicable law, Yema's liability is limited as follows:
- Yema is not liable for psychological, emotional or physical responses arising during or after the Retreat that fall within the known range of effects associated with psilocybin, as described in article 3.
- Yema is not liable for any harm arising directly or indirectly from information you failed to disclose or misrepresented during the admission process.
- Yema is not liable for indirect or economic losses arising from your participation or non-participation (lost income, travel costs, costs arising from early departure, or losses not directly caused by Yema's fault).
- Yema is not liable for the conduct of other participants. While we take reasonable steps to screen applicants and maintain the group container, we cannot guarantee the behaviour of individuals.
- In any event in which Yema is found liable for any claim arising out of or related to your booking or Retreat participation, our total financial liability will not exceed the total amount you paid for the relevant Retreat.
12. Governing law and jurisdiction
These Terms are governed by the law of the country in which the Retreat takes place — Spanish law for retreats held in Spain, Dutch law for retreats held in the Netherlands. Any dispute relating to the interpretation or performance of these Terms will be subject to the non-exclusive jurisdiction of the competent courts of that country.
As a consumer resident in the European Union, you benefit from the mandatory consumer protection provisions of the law of your country of residence. Nothing in these Terms affects those rights.
Informal resolution. Before any legal proceedings, we ask that you first contact us in writing at yema.retreats@outlook.com outlining your concern. We will acknowledge your message within five (5) business days and aim to respond substantively within fourteen (14) days. The vast majority of situations can be resolved through direct conversation.
As a consumer resident in the European Union, you may also refer the matter to the EU online dispute resolution platform: ec.europa.eu/consumers/odr.
13. Changes to these Terms
Yema may update these Terms from time to time. The version applicable to your booking is the one in force at the time you pay your deposit. Updated Terms apply to new bookings only. The current version is published on this page with the date it came into effect.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, it will be modified to the minimum extent necessary to make it enforceable, or removed if modification is not possible. The remaining provisions will continue in full force and effect.
Last updated: 15 June 2026. These Terms will be supplemented with the contact details of Yema's final legal entity (Dutch BV or French SARL — see Legal notice above) once incorporation is finalised.
